Y S Vijayalakshmi, widow of former Chief Minister Y S Rajasekhar Reddy, who had moved the Supreme Court seeking transfer of her petition against Telugu Desam Party president N Chandrababu Naidu and others from the Andhra Pradesh High Court, had to face the same situation which she had encountered in the High Court.
A Supreme Court bench comprising Dalvir Bhandari and Deepak Mishra on Thursday refused to take up her petition, after the defence lawyer Harish Salve brought to the notice of the bench that Justice Bhandari had refused to take up cases in which Reliance Industries Limited was a defendant.
Obviously, Justice Bhandari had stakes in the RIL. The SC bench, then, announced that the case would be transferred to another bench.
Vijayamma faced a similar situation in AP High Court in the past. The HC bench comprising Chief Justice M B Lokur refused to take up the case since he had shares in RIL. The case then got transferred first to Justice Eshwaraiah bench and then later to Justice Rohini bench, thanks to the clever ploy by Naidu’s lawyers using the “not-before-me” tradition in the court.
Vijayamma contended that both Eshwaraih and Rohini had acted in favour of Naidu in the past.
Now, it remains to be seen to which bench Naidu’s case gets transferred in Supreme Court.
